Floyd was indicted on charges of illegal abortion and murder in the death of a 2 lb 5 oz infant boy of approximately 27-28 weeks gestation who survived 20 days following a third-trimester abortion performed in Richland Memorial Hospital, South Carolina in September of 1974. The state dropped charges due to reluctance of the infant's mother to testify and Floyd challenging the constitutionality of the abortion law. Floyd said that he had no reason to believe that the fetus was over 20 weeks gestation, but also said he selected prostaglandin to induce the abortion in an effort not to harm the fetus. (The Columbia State 8-29-75, 8-30-75; Indictment for Murder 43590; Omaha World-Herald 10-19-79; Philadelphia Inquirer 8-2-81; New York Times 3-6-79) Two ex-employees told a news reporter they quit after being asked to flush aborted fetuses with recognizable limbs down the garbage disposal at Floyd's The Ladies Clinic. Floyd was investigated by the Department of Environmental Health for these allegations. A news report says that Floyd was found guilty of disorderly conduct, and sentenced to a $200 fine or 5 days jail, after he "allegedly used racial slurs toward a black protester." He was also charged with simple assault: the victim alleged that he and a companion were approached by Floyd during a picket, verbally harassed, and asked for their permit; when the companion went to get the permit from a car, Floyd slapped the victim's face. Floyd admitted to asking for the permit but denied the assault. He was fined $229.25 or 5 days jail for "Petit Larceny" on March 20, 1991. (Columbia, S.C.
