Womancare operated under the auspices of Detroit Memorial Hospital in that the hospital provided space, personnel, equipment, advertising, and arrangements for referrals. **** Claudia B. alleged that she underwent an abortion at Womancare late in December of 1983. She had what she believed to be a menstrual period on February 27, 1984. On April 9, 1984, Claudia had a positive pregnancy test. In late April and early May of 1984 Claidia went to the emergency room of the Hillsdale Community Health Center with a one week history of bleeding and sudden onset of severe cramping and increased bleeding. On May 3, she underwent a D&C which produced a large amount of placental tissue including a small macerated fetus consistent with a 14 to 16 week pregnancy. The treating physician wrote in Claudia's case summary that the abortion physician "did not remove the gestational productions completely by any means. I suspect that she continued to have a normal pregnancy for a few months after that, when she began to abort spontaneously." Claudia faulted Womancare with failure to analyze the abortion tissue; failure "to ascertain and insure that trained and competent personnel were and would be caring for...Plaintiff and allowed untrained and/or unqualified personnel to do so," and lack of informed consent Claudia had to be hospitalized. (Wayne County Circuit Court Case No. 85-531429) **** Marilyn S. alleged that she underwent an abortion on December 10, 1983. Afterward she wanted to sue, but Womancare would not release her medical records to her attorneys.
