Rand declared bankruptcy in 1992, after facing a total of 30 personal injury and malpractice suits. He was still performing abortions at Clinica Medica Para La Mujer De Hoy at age 83.

Ashleigh P. alleged that she underwent a D&C by Rand on April 23, 1991. She suffered discomfort, pain, anxiety, embarrassment, loss of privacy, physical and monetary loss, and required subsequent surgery. (San Diego County Superior Court Case No. 650363)

Regarding patient Ruth S., “Between March 26, 1998, and May 1, 1998, [Rand’s] records for Ruth do not contain any notation of a physical examination and/or any telephone call. Nevertheless, during this period, [Rand] issued five prescriptions for antibiotics, five prescriptions for a codeine containing medication, three prescriptions for Valium, and prescriptions for 1,320 cc of promethazine-codine syrup.”

Marcia L., age 22, alleged that she'd undergone an abortion May 2, 1990, and that during the abortion Dr. Mitchell at Womancare perforated her uterus and intestines and "shoved the aspirator in more" after she screamed and begged him to stop. Mitchell brought Marcia's husband into the procedure room. Marcia's husband wrapped her in blanket and carried her downstairs, and she was transported by ambulance to Sharp Cabrillo Hospital. She was admitted, vomiting blood.

The next day her abortion completed by Rand, who then discharged Marcia despite persisting pain and vomiting. Marcia suspected that she was suffering from a perforated uterus and stomach, but Rand diagnosed indigestion. Marcia refused to go home. A barium enema showed intestinal blockage, but Rand discharged Marcia anyway.

Three days later Marcia returned to Sharp Cabrillo, where she saw different doctor. Marcia underwent immediate and subsequent surgery which removed 2 1/2 feet of intestine. She required the insertion of a 35-foot tube from her throat to her anus, and was hospitalized for 60 days. She also was left infertile.

Marcia did not understand that personal injury attorneys operate on a contingency fee basis, so she served as her own attorney against Rand, thinking she could not afford legal help. Marcia alleged that Rand told her they'd had no complaints in 15,000 patients annually. Marcia said that even 12 days after her abortion, Rand dismissed her complaints, saying that he had a medical degree and she should shut up and let him make the diagnosis. The medical board, in reference to patient Lorena L., said that Lorena was seen by Rand January to May of 1990. She had a family history of diabetes. Rand failed to evaluate and treat obvious urinary tract problems. “On May 12, 1990, Lorena delivered a macerated stillborn.”

Sherry P. said that Rand failed to remove her entire fetus during a February 1988 abortion at Womancare, resulting in hysterectomy.

Deborah B. alleged that she sought diagnosis for a physical complaint on September 19, 1990. Rand urged abortion, but failed to disclose risks and alternatives. He discharged her still in pain and bleeding. Deborah subsequently expelled a headless fetus into the toilet at home. She suffered "mental, emotional, and psychological anguish, suffering, and injury." (San Diego Superior Court Case No. 642682, San Diego News Notes February 1995)

Medical board documents about Emelia F. indiate that Rand delivered Emelia’s 11th child on March 30, 1986, then performed a routine post-partum tubal ligation. The pathologist’s report indicated that one of the specimens labeled as tube contained no tube. Rand did not notify Emelia. “In April 1987, Emelia suspected that she was pregnant with her 12th child. [Rand] informed her that she could not be pregnant because he performed a tubal ligation.” Rand examined her, discovered that she was pregnant, and told her that the old tubal ligation would prevent future pregnancies. Rand offered an abortion. Emelia gave birth to baby on October 11, 1987.

Debra R., age 24, alleged that she underwent an abortion by Rand January 21, 1981. She had to be hospitalized, and surgery revealed infection and over half of fetal material retained. Debra had to have a hysterectomy. (San Diego Superior Court Case No. 479972)

Sherry P. alleged that she called Rand's office with complaints of cramping following her abortion, but told it would subside. She developed an infection due to retained fetal parts and required a hysterectomy. (San Diego County Superior Court Case No. 640446)

Shirley B., age 17, alleged that Rand refused to treat her for bleeding during her pregnancy. her repeated unscheduled visits to his office, seeking care for this bleeding, were met with no treatment. Shirley and her boyfriend said that Rand was "cold, gruff, and insulting" in a May 12, 1975 visit, told her that there was nothing wrong with her, and "yelled and screamed" that she was going to lose the baby anyway so she should get out of his office.

Shirley requested treatment in a hospital to try to save her baby, but Rand refused, stating that he did not run a taxi service. When Shirley experienced a gush of blood, Rand refused to allow a nurse to take Shirley to the hospital

Shirley suffered the premature birth and subsequent death of infant Sherelee. Rand settled out of court. (San Diego Superior Court Case No. 382675)

The February, 1995 issue of San Diego News Notes indicates that Rand declared bankruptcy in March of 1992 due to the loss of a multi-million dollar lawsuit by Pamela B., who suffered toxemia and detached placenta causing her son to be born brain damaged fifteen years earlier. Rand said in hearings that he would have to close his offices. Thank God.

Pamela said that she had called Rand to report heavy bleeding, which was alarming her. He told her to go back to sleep, but when the bleeding continued she rushed to the hospital. Rand dallied for an hour before finally doing an emergency c-section.
